General Policy
TrackThatAd.com general policy is to act as a provider of
an uRL tracking system from our servers in California, USA. TrackThatAd.com reserves the right to suspend or
cancel a Client's access to any or all services provided by TrackThatAd.com
when TrackThatAd.com decides that the account has been inappropriately used.
TrackThatAd.com forbids anyone from using our services
for tracking any URLs that contain anything illegal. This includes
pornographic, racist, abusive, or anything that may possibly offend.
You are only allowed one free account. Anyone found with
double accounts will have them removed.
Payment Policies
Client agrees to pay all charges relating to the use of
Client's account(s) according to rates and prices stated on said sales order
at the time of commencement. All accounts are set up on a pre-pay basis.
TrackThatAd.com reserves the right to change prices at any time. Payments
are presently set up to be paid via Credit card or Paypal through Clickbank.
Cancellation
Refunds will be issued to you via Clickbank.
Right To Refuse Service
TrackThatAd.com reserves the right to cancel service at
any time to anyone for any reason. We enforce this policy to ensure a
professional environment for the users of our system.
Lawful Purpose
Clients that use our system for illegal activities will
have their account(s) immediately cancelled without refund of any fees. This
applies to paid and free accounts. Client hereby agrees to indemnify and
hold harmless TrackThatAd.com for any claim resulting from the use of
illegal materials.
Password Protection
Client is responsible for all use of their Client's
account(s) and confidentially of password(s). TrackThatAd.com will not be
responsible for lost, stolen or otherwise compromised passwords.
Spam and Abuse
TrackThatAd.com and its owners will at its own discretion
use the full extend of the law to prosecute any client making use of
TrackThatAd.com for the puposes of spam and / or abuse. This includes, but
is not limited to, sending of unsolicited email.
Disclaimer
TrackThatAd.com will not be responsible for any damages
your business may suffer. TrackThatAd.com cannot and does not exercise any
control whatsoever over the information passing through its network or
through the Internet. TrackThatAd.com reserves the right to revise its
policies at any time.
Client understands that TrackThatAd.com services may be
interrupted for several reasons, including but not limited to: malfunctions,
maintenance, improvement or other problems out of our control.
Client understands that it may not receive advance
notification of any such interruption of service. Anytime we have a
scheduled outage, Client will be notified in advance via e-mail.
TrackThatAd.com shall not be liable for any delay in or failure to perform
the services caused by circumstances entirely beyond its control such as
those occasioned by acts of God or other causes or which it could not have
reasonably foreseen or any other cause which similarly impedes the providing
of service.
USE OF
TrackThatAd.com TRACKING SERVICE IS AT THE CLIENT'S SOLE RISK.
TrackThatAd.com SERVICES ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS.
Neither TrackThatAd, CH-Design, its employees, affiliates, third party
services, merchant licensors or the like, warrant that the service will not
be interrupted or error free. TrackThatAd will make every good faith effort
to ensure that its web servers are available to as many Internet users as
possible and that there is minimal interruption of service as possible
Under no circumstance will TrackThatAd, CH-Design, its partners, its
employees, or its affiliates be liable for any claims, any action either
direct, indirect, special, incidental, or consequential, or any damages
either punitive or alleged to have resulted, including loss of profits, from
the use of or inability to use the service, from service interruptions, from
customer errors or problems with their Internet connectivity, from the
client's equipment or available technology, from unauthorized access to
TrackThatAd servers, from communication failure, from bandwidth congestion
or interruptions, loss of data, from any type of configuration error, or
from acts of God
Entire Agreement
This Agreement constitutes the entire understanding of
the parties. Any changes or modifications to this contract thereto are
agreed to by both parties upon renewal of services.
